1 0 نحو تفعيل التدقيق الشرعي الشامل على أعمال المصارف اإلسالمية في الع ارق مد هشام عمر حمودي عبد كلية الحدباء الجامعة / قسم المحاسبة ) 5 ( المستخلص إن فلسفة المصارف اإلسالمية قائمة على االلت ازم بالشريعة اإلسالمية ومنها استمدت هذه المصارف تسميتها ولكي يقال أن هذه المصارف إسالمية يجب أن تقدم مجموعة من األنشطة والخدمات تتوافق مع الشريعة اإلسالمية وبهذا تميزت عن المصارف األخرى لذا كان البد من أن يتأكد الجميع أن تلك المصارف سارت على النهج الذي ر سم لها فترى المصارف اإلسالمية في الدول التي لها باع في التطبيق لديها هيئة رقابية شرعية تجمع بين الفتوى والرقابة ولديها كذلك هيئة شرعية متخصصة بفقه المعامالت المالية فضالا عن فريق الرقابة الداخلية الشرعية داخل تلك المصارف والرقابة الخارجية الشرعية خارج تلك اس ست المصارف والمتخصصين من مكاتب م ارقبي الحسابات وجميعها لها هدف واحد وهو تحقيق االلت ازم بالشريعة المصارف اإلسالمية في الع ارق عام والبنك المركزي أصدر تعليماته بشأن الصيرفة اإلسالمية عام اإلسالمية مما يعني أن الوصول إلى التشكيلة المثلى من الرقابة الشرعية يبدأ بالخطوة األولى وهي تفعيل التدقيق الشرعي الشامل على أعمال تلك المصارف إن تفعيل التدقيق الشرعي الشامل يبدأ بشخص متخصص أو مجموعة أشخاص متخصصين ضمن فريق الرقابة الداخلية داخل تلك المصارف توجه أعمال المصارف لاللت ازم بالشريعة وبذلك تحقق التفعيل الداخلي الشرعي وي كمل ذلك بشخص أو مجموعة أشخاص متخصصين ضمن فريق الرقابة الخارجية ت ارقب وتطمئن المجتمع بصحة االلت ازم وبذلك يتحقق التفعيل الخارجي الشرعي فالتفعيل يبدأ خطوة خطوة للوصول إلى تحقيق أهداف مستقبلية من أهمها وجود هيئة رقابية شرعية متخصصة بالعمل المصرفي اإلسالمي Towards Activating The Comprehensive Sharia Audit on The Work of Islamic Banks in Iraq Hashim Omer Hamoudi Abstract The philosophy of Islamic banks based on commitment Islamic Sharia and from which these banks derived named and to say this bank is Islamic bank it must provide a range of activities and services compatible with Islamic Sharia and this distinguished it from other banks, so it was necessary to make sure that each bank of these went on the sharia approach, Islamic banks in countries that have wide application has a regulator legitimacy combine fatwa and control and has also the legitimacy of specialized jurisprudence financial transactions as well as the legitimacy Internal control Group within those banks and external legitimacy control are outside those banks and specialists from the offices of the auditors and all have one objective of achieving a commitment to Islamic Sharia The beginning of the idea of Islamic banking started in Iraq in and the Central Bank instructed on Islamic banking in 0, which means that access to the best form of Shari'a begin with the first step, which is activity of a comprehensive sharia audit on the work of these banks The activation of comprehensive sharia audit destruction originates specialist person or group of specialists persons within the Internal control Group in those banks which direct to comply with Sharia law and thus achieves activation of internal legitimate and is complemented by a person or group of specialists persons within a team of external control which is monitoring and assuring the right commitment and thus achieved by activation of outside control legitimate, activation start step by step to achieve the future objectives and the most important is legitimate control body specialized in Islamic banking
